Terms of Service

These Terms are an agreement between you and Vangture LLC, a Wisconsin limited liability company ("Vangture", "we", "us"), for your use of the Vangture app, the Vangture Vendor app and vangture.com (the "Service"). By using the Service you agree to these Terms and our Privacy Policy. Vendors also agree to the Vendor Agreement.

1. What Vangture is (and isn't)

Vangture is a platform that lets independent restaurants, food trucks and home food sellers ("Vendors") list their food, hours and deals, and lets customers find them and place orders for pickup.

Vangture does not prepare, sell, handle, inspect or deliver food. Each Vendor is an independent business, solely responsible for its food, including ingredients, allergens, preparation, safety, quality, quantity, labeling, licensing and permits, and for honoring its listed prices and orders. Your purchase is a transaction between you and the Vendor.

Information such as menus, prices, hours, open/closed status, deals and food-truck locations is provided by Vendors and may be inaccurate or out of date. Always confirm allergens and dietary needs directly with the Vendor.

2. Eligibility and accounts

• You must be at least 18 years old to create an account or place orders.
• Keep your sign-in details secure. You're responsible for activity on your account.
• Give accurate information, including the name you use for pickup.

3. Orders and payment

• Orders can only be placed with Vendors that are open. A Vendor may accept or decline an order, for example if an item is sold out.
• You pay the Vendor directly at pickup. Vangture does not charge you and does not process payments. Final prices, taxes and accepted payment methods are set by the Vendor.
• You can cancel an order in the app until the Vendor accepts it. After that, contact the Vendor.
• Please pick up orders you place. Repeated no-shows may lead to restrictions on your account.
• Deal and sale prices are set by Vendors and may end at any time, or when the items run out.

4. Reviews and content

• You may review a Vendor after picking up an order. Reviews must be honest, based on your own experience, and must not include hate, harassment, threats, private information about others, or spam.
• Reviews are public and show your first name. You give Vangture a non-exclusive, worldwide, royalty-free license to display, reproduce and distribute your reviews in connection with the Service.
• We may hide or remove content that breaks these Terms. Vendors may not offer rewards for positive reviews.

5. Acceptable use

Don't misuse the Service. For example, don't: place fake orders; impersonate others; scrape or copy the Service or its data; interfere with or try to access the Service, other accounts or our systems without permission; or use the Service for anything illegal.

6. Location

Map features use your device's location with your permission. Food-truck locations shown on the map come from Vendors' devices and may not be exact.

7. Our rights

The Service, including the Vangture name, logo, design and software, belongs to Vangture LLC. We may change, suspend or stop any part of the Service, and may suspend or close accounts that break these Terms or put others at risk.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, VANGTURE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. VANGTURE MAKES NO WARRANTY ABOUT ANY VENDOR OR ANY FOOD, INCLUDING ITS SAFETY, QUALITY, ALLERGENS OR LEGALITY, OR ABOUT THE ACCURACY OF VENDOR-PROVIDED INFORMATION.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, VANGTURE LLC AND ITS MEMBERS, MANAGERS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY ILLNESS, INJURY OR LOSS ARISING FROM FOOD OR SERVICES PROVIDED BY VENDORS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF $50 OR THE AMOUNT YOU PAID VANGTURE IN THE 12 MONTHS BEFORE THE CLAIM. SOME STATES DON'T ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

10. Indemnity

You agree to defend and hold harmless Vangture LLC from claims arising from your misuse of the Service or your violation of these Terms or of law.

11. Disputes and governing law

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules. Before filing a claim, please contact us at support@vangture.com so we can try to resolve it informally. Any dispute that isn't resolved will be brought in the state or federal courts located in Wisconsin, and you and Vangture consent to their jurisdiction. Either party may bring a qualifying claim in small-claims court.

12. App stores

If you downloaded the app from Apple's App Store or Google Play, these Terms are between you and Vangture LLC, not Apple or Google, and Vangture, not Apple or Google, is responsible for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms for iOS users and may enforce them.

13. Changes and contact

We may update these Terms. If the changes are significant, we'll notify you in the app or by email before they take effect. Continuing to use the Service after that means you accept the updated Terms.
